ItalianoIn the sectors of legal and business translation, a sworn translation is often necessary to ensure the legal validity of the translated material in the country where it is to be used.
THE SERVICE
Sworn translations (i.e. where a translator swears to the validity of the translation before a Court officer) provide official certification on the part of the translator that his/her translation is faithful to the source text. This service is, for example, requested for contracts, letters of appointment, legal documents, CCIAA (Chamber of Commerce) certification, birth/death/marriage documents and international adoption documentation.
REFERENCE STANDARDS

REQUISITES AND REQUIRED DOCUMENTATION
The translator must personally bring the original text and its translation (or an authenticated copy of it) to the relative office, in the presence of a Court officer or Justice of the Peace, and must also show photographic ID (non-Italian citizens need to show the original of their provisional residence permit). To these documents the sworn translation report, compiled in full and signed by the translator, is added.
The report indicates that the translation task in question has been executed “correctly and faithfully… for the sole purpose of ascertaining the truth”. By signing the report the translator assumes official civil and penal responsibility for the translation. In the event that some parts of the document have not been translated, the latter must be specified.
Translators are not allowed to swear an oath on translations from one foreign language into another foreign language without at least one translation being made into Italian. For example, if the customer requires a sworn English translation of a document originally written in German, that document must first be translated from German into Italian and this first translation must itself be sworn. Subsequently, a second translation is made from Italian to English, with a second oath being sworn on the latter.
The last page of every translation must, prior to the sworn translation report, carry the translator’s signature; the signature and date on the sworn translation report must be written in the presence of the Court officer.
JURISDICTION AND VENUE
Swearing an oath on a translation is a public deed that is the pertinence of the Registry of any Judicial Office, including the Office of the Justice of the Peace.
TAX REQUIREMENTS
A €16 duty stamp must be affixed to all sworn translations, one duty stamp every 100 lines starting from the first page (no page may have more than 25 lines). Duty stamps must be affixed to both the original documents and their translations and the calculation of the number of lines must also take into account the sworn translation report itself.
